1. GENERAL TERMS
‍a. These Booking Terms and Conditions apply to the booking of Elev8 (the ‘Activities”) and any ancillary products at the location set out in the booking confirmation.
b. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.
c. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Elev8.
d. Any typographical clerical or other error or omission in any booking confirmation or other documentation issued by Elev8 (including any electronic documentation) shall be subject to correction without any liability on the part of Elev8. Elev8 reserves the right to make changes to the Activities whether to conform with any applicable safety or other statutory requirements or otherwise.

2. BOOKING CONFIRMATION
‍a. No booking shall be deemed to have been accepted unless accepted in writing by Elev8 (which shall include Elev8 email confirmation of booking).
b. These Booking Terms and Conditions incorporate Elev8 Privacy Policy and Disclaimer.
c. You must advise Elev8 as soon as possible of any mistake in Elev8 booking confirmation. Elev8 shall use its reasonable endeavours to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances including lack of pre-completed waivers upon arrival

3. SAFETY
‍a. The Activities comprise a challenging physical activities and participation is not without risk as a fall could be fatal. All participants will receive a safety brief.
b. Elev8 reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.
c. After the safety briefing participants will not be directly supervised by an instructor.d. All participants must be reasonably fit and healthy and must weigh less than 21 stones/133kg.If you have any concerns, we advise that you visit the site at a time prior to your booking and speak to a member of the Elev8 staff. Anyone who does not meet these requirements will not be allowed to undertake the Activities. It is your responsibility to ensure that all members of your party meet these requirements.All participants aged 4 and under* must be accompanied by a participating person aged 16 or above. Prices are on a per person basis and are not depending on age.e. All participants are required to wear socks for grip and hygiene.f. The Activities are physically demanding and require a degree of agility, strength and stamina. Participants are advised to jump within their ability – only the individual knows or understands their own limits and competencies. If you are unsure of whether you can complete a manoeuvre, you should not attempt it If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the Activities pregnant women are unable to take part due to the risks to them and to their unborn child.g. Participants need to be able to see similar distances to those required to drive a car in order to be able to complete the activity and to supervise any under 18’s in their care. Consequently, short or long sighted participants must ensure that they wear contact lenses or prescribed glasses.h. All participants are required to act responsibly and courteously at all times and to respect other participants. Elev8 shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.i. Participants must be dressed appropriately (see clause 4) and Elev8 reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.j. No refunds or compensation will be payable by Elev8 in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for the reasons set out in this clause.k. All participants age 14 and under must be accompanied in our parks by an adult (16+) for the duration of their visit. The adult does not have to take part in activities but must be present in the building, unless the participant is aged 4 or under, in which case the adult must be a paying participant and supervise the age 4 or under on the park.

4. CLOTHING
‍a. It shall be the responsibility of all participants to ensure that they are dressed appropriately and Elev8 advises participants to wear clothing appropriate for the activity and which they do not mind getting damaged. The following restrictions shall apply:i. Participants must wear Elev8 Safety socks, no other socks will be accepted on park.ii. Long hair must be tied backiii. No belts, jewellery or other sharp items of clothing that may cause damage to yourself, the equipment or other participants.
b. Elev8 will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the Activities.

5. PRICE AND PAYMENT
‍a. Subject to any terms agreed in writing between Elev8 and you, our charges shall be calculated at our current rates and payment in full shall be due at the time of booking. The charges include the cost of purchasing the Activities. Payment may be made by debit or credit card either on line or by contacting the booking line on our website.
b. All Elev8 party bookings must be secured by a non refundable deposit payment of 25%. The remaining party balance must be paid in full a minimum of 7 days in advance of a party and any amendments including requesting a cancellation to Elev8 party booking must be made 7 days prior to the date of the booking including amending guest numbers, food choice options and times.

6. CANCELLATIONS, REFUNDS AND AMENDMENTS
‍a. You shall be entitled to cancel your session booking (this does not include parties) subject to Elev8 receiving your request for cancellation at least 4 hours before the booked start time during opening times, Term Time Monday -Friday 11am - 6pm Saturday 10am-6pm Sunday 9am - 4pm School Holidays Monday 10am - 6pm Tuesday - Friday 11am - 6pm Saturday 10am - 6pm Sunday 9am - 4pmAny requests for cancellation must be made by emailing info@elev8fun.co.uk directly including when you would like to move the booking to so we can update this for you. Elev8 do not offer refunds back to the original payment methods or onto gift cards to use at another time.
b. Elev8 shall be entitled to cancel your booking at any time. In the event that Elev8 has to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. In the event of cancellation under this clause Elev8 may refund your booking either wholly or in part via a digital gift card or will transfer your booking to another date but no other compensation shall be payable.
c. In the event that it proves necessary to close the Activities for reasons beyond the control of Elev8, Elev8 may, but shall not be obliged to, offer alternative dates or times at which to undertake your booking, in these circumstances refunds will not be issued. It may also be discretionary that Elev8 may offer Digital Gift cards to use within 12 months, no refunds are to be given back to the original payment method due to restrictions on our booking system. In circumstances where your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole).
d. In the event of localised lockdown enforced by government, Elev8 may, but shall not be obliged to, offer alternative dates or times at which to undertake your booking (inc party and group bookings), in these circumstances refunds will not be issued. In circumstances where your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole).
e. Party bookings are non-refundable or transferable. No refunds either partial or full will be provided. All non refundable deposits reflect a estimate of direct loss to Elev8 through third party booking fees, transaction fees and administrative costs that are out of Elev8's control.
f. None of the conditions above affect your statutory rights.g. Any bookings made by error will not be subject to refunds and will only be transferable to a new date/time.h. Our on site team will be unable to process any refunds onto gift cards.i. Memberships can be cancelled 5 days prior to the renewal date only by emailing info@elev8fun.co.uk Any cancellations during this period may result in renewal for a further month/time period as agreed in your membership and will not be subject to any refunds.
j. If you need to cancel your party due to illness or other situations that may arise 5 days/ less before your booking date we may be able to facilitate a transfer of your party booking (subject to Availability) This will incur a fee being 25% of the booking balance. Please email info@elev8fun.co.uk in this instance.

7. LIABILITIES
‍a. Except as otherwise provided in these Booking Terms and Conditions Elev8 shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.
b. Parking facilities are available at the site, and any vehicles are left at the owners’ risk and subject to any conditions and the payment of any fees as may be required by the provider of such facilities at the site location.
c. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of Elev8 in respect of death or personal injury caused by the negligence of Elev8 or of its employees, agents or contractors.

8. MISCELLANEOUS
‍a. If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
b. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.
c. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and Elev8 and you submit to the exclusive jurisdiction of the courts of England and Wales.

9. SECURE PAYMENT
‍Elev8's payment options use advanced SSL encryption to keep your transaction secure and do not cost you anything to use (Elev8 is charged as the seller, you are not charged as the buyer) so you will not pay any extra for your order. You do not need to hold an account with these Merchants to use these methods of payments.

10. PRIVACY AND PROTECTION OF PERSONAL DATA
‍The details you give us are essential for the processing. By registering on the Site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present general Terms and Conditions.

You have the permanent right to access and rectify all the information that concerns you, in accordance with European texts and national laws in place (article 34 of the law of 6 January 1978). You can at any time make a request to Elev8 to find out what personal information we hold concerning you. You may at any time, and by request, modify this information.Cookies record certain information stored on your hard drive. This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Cookies do not contain any confidential information about you.

11. INTELLECTUAL OWNERSHIP
‍All the content on Elev8 website (illustrations, texts, names, brand names, images and videos) is the property of Elev8. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Elev8. All information, content and files are protected by International law concerning intellectual ownership and copyright. Elev8 cannot give you the right to copy, display or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.Elev8 will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.

12. WAIVER AND SEVERABILITY
‍Any failure of Elev8 to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Elev8, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

13. FEEDBACK & COMMENTS
‍Any opinions left on the Website by Elev8 customers are screened and moderated by Elev8. If the comments infringe on the law or are inappropriate (abusive publicity, defamation, insults, out of context commentary…), Elev8 reserves the right to refuse or modify it.

14. Memberships
‍a. Elev8 reserves the right to amend or making changes to its membership programme with no written warning to existing membership holders.
b. All memberships must only be used by a sole participant, memberships cannot be used or transferred to another non named participant at any time.
c. All memberships operate on a rolling monthly payment and you may cancel at any time providing you provide a minimum of 5 working days notice by emailing info@elev8fun.co.uk
d. Any cancellations by phone or any other means will not count as written notice.
e. Members are urged to book in advance to secure their session as during peak times Elev8 may reach full capacity and this will result in refusal of entry and bear no compensation.
f. If a membership has been found to be misused Elev8 reserve the right to cancel the membership with immediate effect and no compensation will be issued.
